The laws surrounding Human Growth Hormone can be quite confusing. Let’s break it down into an understandable format that the average person can better understand. Let’s start with the history of HGH law and follow the changes that have occurred over the years.

It was under a law passed by congress that the distribution of Human Growth Hormone was first prohibited unless there was a doctor who prescribed HGH for the treatment of a medical condition. The original law came into place after the Federal Food Drug and Cosmetic Act received allegations that people were distributing anabolic steroids without a prescription, which was required.

Pursuant to 21 U.S.C. § 353(b)(1)(B) “prescription drugs such as anabolic steroids and/or human growth hormone could be legally distributed only in those instances in which a physician, based upon an individualized determination of a proper course of treatment, authorizes the drug's distribution to a patient under his supervision.”

When these prescription human growth hormone are distributed in a way that does not meet this criteria, they are considered misbranded drugs and therefore are illegal for distribution.

Pursuant to 21 U.S.C. § 353(b). Distribution of prescription drugs outside these restrictions has resulted in the prosecution and conviction of laypersons, [FN1] pharmacists, [FN2] and physicians. [FN3]

Should illegal distribution of human growth hormone occur, where the distributing party knowingly misleads or defrauded consumers or the governing federal or state agencies, one could face three years in jail.

FN4. Using the Federal Food, Drug, and Cosmetic Act, the government must establish an interstate nexus. Thus, the government must prove either that any one of the components of the anabolic steroids and/or human growth hormone travelled in interstate commerce before the drug was misbranded and held for sale, see 21 U.S.C. § 331(k), or the government must establish that the individual caused the delivery for introduction into interstate commerce of the misbranded human growth hormone and/or misbranded anabolic steroids, see 21 U.S.C. § 331(a).

In 1988, there was an amendment made to the act because the government agencies were concerned about an increase in the amount of human growth hormone and anabolic steroids that were being illegally sold and they felt it was presenting an increased health risk to young athletes. As a result, there were two amendments added by congress. The amendment was designed to criminalize the trafficking of human growth hormone and steroids. The first amendments became part of the 1988 Anti-Drug Abuse Amendments on November 18, 1988 it took effect. Human growth hormone remained legal if it was

1. Done pursuant to a doctor’s order, and
2. It was to treat a disease.

Congress wasn’t done - in 1988, the act was also changed to allow the government to seek forfeiture of property for any felony crime involving human growth hormone or anabolic steroids a violation of the Federal Food, Drug, and Cosmetic Act.

Pursuant to 21 U.S.C. § 333a, “Any conviction for a violation of section 303(e) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. § 333(e)), or any other provision of that Act, involving an anabolic steroid or a human growth hormone shall be considered, for purposes of section 413 of the Controlled Substances Act (21 U.S.C. § 853), a conviction for a violation of title II of the Comprehensive Drug Abuse Prevention and Control Act of 1970, if such violation of the Federal Food, Drug, and Cosmetic Act is punishable by imprisonment for more than one year.”

In 1990, Congress once again amended the laws relating to human growth hormones and steroids. The controls became far more stringent and there were higher criminal penalties put into place for the illegal distribution of HGH and anabolic steroids.

The regulation and the distribution of both human growth hormones and anabolic steroids became a Schedule III controlled substance. The criminal penalty became a five-year felony for the possession and distribution with intent to distribute HGH for any use other than the recognized medical conditions for which it is authorized. The 1990 Act also added the additional penalty of criminal forfeiture for any conviction involving the distribution of HGH. The act increase imprisonment to 10 years if human growth hormone was distributed to anyone under the age of 18.

Prosecuting for human growth hormone distribution is so different from any other FDCA drug prosecution. First, there is no requirement for them to have proof of distribution of the HGH. Prosecuting those individuals that are not physicians for HGH distribution is the equivalent of prosecuting a narcotics case.

Currently there are two authorized manufacturers of HGH; both have very strict restrictions for their product distribution to make sure that it is only physicians have access to the HGH. Current restrictions allow only hospital pharmacies to order human growth hormone. Local pharmacies are not permitted to order human growth hormone.

As a result of this ruling those cases of distribution of HGH that do not involve a doctor will generally be:

1. Counterfeit human growth hormone
2. Smuggled human growth hormone
3. Diverted human growth hormone

Today, human growth hormone remains illegal and professional sports are increasing regulations and testing related to the use of HGH injections in sports. HGH injections remain only available legally through a physician for a designated medical condition.

A better option for anyone wanting to enjoy the benefits of HGH is to use legal HGH supplements rather than getting involved in illegal HGH injections.
